Walgreens has agreed to pay $100,000,000 to settle a class action lawsuit for allegedly inflating its usual and customary prices by not considering its Prescription Savings Club prices.
Who can file a claim?
The Settlement Class includes:
- Individuals and entities in the United States and its territories who paid for prescription drugs at Walgreens using insurance benefits from January 1, 2007, to November 18, 2024
- Third-party payors, such as health insurers, who paid for prescription drugs for their members or employees
To qualify, you must have used prescription insurance benefits when purchasing the drugs.
How much are the payouts?
The settlement fund will be distributed among eligible claimants based on the amount paid for prescription drugs.
The distribution is divided into two pools:
- Third-Party Payors (TPP Claimants): 80% of the Net Settlement Fund.
- Individual Claimants: 20% of the Net Settlement Fund.
Payments are calculated on a pro rata basis. For example, if the Net Settlement Fund is $80,000,000 for TPP Claimants and a claimant's recognized claim is $1,000,000, their share would be proportionate to the total claims in that pool.
Is proof required to submit a claim?
Yes, proof is required:
- Known Individual Claimants: No documentation is needed if claiming less than $10,000.
- Unknown Individual Claimants and TPP Claimants: Must provide proof of payments, such as receipts or statements.
