Who can file a claim?

Who is excluded from the class?
- Individuals who paid for all their prescription drugs without using insurance.
- Federal and state government entities, except government-funded employee benefit plans.

How much is the payout per person?
The settlement fund of $100,000,000 will be divided into two pools:
- 80% for third-party payors (TPP Claimants)
- 20% for individual claimants (Individual Claimants)
The exact amount each claimant will receive depends on the total claims submitted and the amount they paid out-of-pocket for prescriptions. The distribution is calculated on a pro rata basis within each pool.

$100 Million settlement fund breakdown
The settlement fund of $100,000,000 will cover attorneys' fees, service awards, and administrative costs.
- Attorneys' fees: Up to 30% of the settlement fund.
- Litigation expenses: Up to $3,000,000.
- Service awards: Up to $5,000 for each individual plaintiff and $15,000 for each fund plaintiff.
- The remaining Net Settlement Fund will be distributed to eligible claimants.
