Florida Health Sciences Center, Inc., doing business as Tampa General Hospital, has agreed to pay $6.8 million to settle a class action lawsuit for alleged negligence, breach of implied contract, and violations of the Florida Deceptive and Unfair Trade Practices Act.
Who can file a claim?
To be eligible for the settlement, you must have received a notification from Tampa General Hospital indicating that your private information was potentially compromised during the data security incident between May 12, 2023, and May 30, 2023.
The personally identifiable information (PII) and protected health information (PHI) involved in the incident includes names, addresses, telephone numbers, dates of birth, Social Security numbers, health insurance information, medical record numbers, patient account numbers, dates of service, and limited treatment information.
How much can class members get?
- Cash Payment A: Up to $1,500 for ordinary losses, including out-of-pocket expenses and lost time, with proper documentation.
- Cash Payment B: A flat payment of $125 if you choose not to claim under Cash Payment A.
- Extraordinary Losses: Up to $7,500 for documented extraordinary losses directly caused by the data breach.
- Credit Monitoring: One year of free credit monitoring services from three bureaus.
Cash payments may be subject to pro rata adjustments based on the total number of valid claims filed. If the settlement fund is insufficient to cover all claims, payments may be reduced proportionally.

$6.8 Million Settlement Fund
The settlement fund of $6.8 million will cover various expenses related to the settlement. Class member payments, including ordinary and extraordinary losses, credit monitoring, and legal fees, will be deducted from the fund.
Class Counsel will request up to 33.33% of the fund for attorney fees, plus reimbursement of costs. The remaining funds will be distributed to class members based on valid claims.
