If you worked as an hourly, non-exempt employee for Crocs Retail, LLC in California at any time between January 3, 2019, and December 31, 2024, you may be eligible to receive a cash payment from a class action settlement.

Crocs Retail, LLC has agreed to pay $1,000,000 to resolve a class action lawsuit alleging violations of California wage and hour laws. The lawsuit claimed that Crocs failed to pay minimum and overtime wages, did not provide proper meal and rest breaks, issued inaccurate wage statements, and failed to reimburse business expenses, among other alleged violations.

Who is eligible for a Crocs settlement payout?

You are a class member if:

  • You were employed by Crocs Retail, LLC in California as an hourly, non-exempt employee
  • Your employment occurred at any time between January 3, 2019, and December 31, 2024 (the “Class Period”)

There are two main groups within the settlement:

  • Class Members: All individuals who worked as hourly, non-exempt employees for Crocs in California during the Class Period.
  • Aggrieved Employees: Individuals who worked as hourly, non-exempt employees for Crocs in California during the PAGA Period, which is from February 14, 2023, through December 31, 2024.
    • Aggrieved Employees are eligible for a separate payment under California’s Private Attorneys General Act (PAGA).

Class members are further divided into:

  • Participating Class Members: Those who do not opt out of the settlement and will receive a payment based on the number of weeks they worked during the Class Period.
  • Non-Participating Class Members: Those who submit a valid and timely request for exclusion (opt out) and will not receive a class payment, but may still receive a PAGA payment if they qualify as Aggrieved Employees.

How much will my class action payment be?

  • Participating Class Members: You will receive a pro rata cash payment based on your number of workweeks during the class period.
  • Aggrieved Employees: Class members that were employed at anytime during the PAGA period will receive an additional pro rata cash payment based on PAGA pay periods worked.
  • Non-Participating Class Members: You will only receive the Aggrieved Employee PAGA payment, amount determined by the number of PAGA pay periods worked during the qualifying period.

No claim form required

Class members do not need to file a claim to receive your payment. The settlement administrator has current and former employee information and will automatically issue payments to all eligible class members and aggrieved employees.

How will class members get paid?

Eligible class members and aggrieved employees will receive a paper check mailed to the address on file with Crocs.

$1 Million Crocs class action settlement fund

The $1,000,000 settlement fund will cover these payments:

  • Settlement administration costs: Not to exceed $19,750
  • Attorneys’ fees: Up to $333,333.33
  • Attorneys’ expenses: Up to $35,000
  • Service awards to class representatives: Up to $7,500 each for four representatives, a total of no more than $30,000
  • PAGA penalties: $10,000 total ($7,500 to the state, $2,500 to aggrieved employees)
  • Payments to class members: Remaining settlement funds

  • Final Approval Hearing: July 9, 2025

When is the Crocs class action payout date?

The final hearing is scheduled on July 9, 2025. Payments will be distributed approximately 67 days after the court grants final approval.

Why did Crocs settle this class action lawsuit?

The class action lawsuit alleged that Crocs Retail, LLC violated California labor laws by failing to pay minimum and overtime wages, not providing proper meal and rest breaks, failing to reimburse business expenses, and issuing inaccurate wage statements.
