OpenGov, Inc. has agreed to pay $467,980 to settle a class action lawsuit for allegedly failing to include required wage scales, salary ranges, and/or general descriptions of benefits and other compensation in job postings, as required by Washington law. Who is eligible for a settlement payment?
You are a class member if you meet the following criteria:
- You applied for a job opening with OpenGov, Inc. in Washington State between January 1, 2023, and February 25, 2025.
- The open position you applied for did not disclose the wage scale or salary range and/or did not provide a general description of all benefits or other compensation available.
How much is the class action payout?
Pro Rata Cash Payment: Approved claimants will receive a cash payment estimated at $1,279.19. Final amount will be determined by the number of claims submitted.
How to claim a class action settlement payment
To receive a class action rebate, class members must submit a claim. You can file a claim online or mail the form included with your notice to the settlement administrator.

Is proof required to submit a claim?
No, supporting documentation is not required. After your claim is validated by the settlement administrator, you will receive a request for a W9 form.

Approved claimants will receive a paper check mailed to the address provided on the claim form.
$467,980 settlement fund breakdown
The settlement fund of $467,980 will include the following:
- Administrative costs: Should not exceed $20,000
- Attorneys’ fees and costs: $202,960
- Service awards to class representatives: $12,500 each, a total of $25,000
- Payments to approved claimants: Remaining settlement balance

When is the OpenGov class action settlement payout date?
The court has scheduled the final approval hearing on July 9, 2025. Payments will be issued to class members with valid claims after final approval is granted.
Why was there a class action settlement?
This lawsuit was filed because plaintiffs alleged that OpenGov, Inc. failed to include required wage and benefit information in job postings, in violation of Washington law (RCW 49.58.110). OpenGov denies any wrongdoing, but agreed to settle the lawsuit to avoid a possible trial.
