Somnia, Inc. has agreed to pay $2,425,000 to settle a class action lawsuit for allegedly failing to adequately protect personal information during a 2022 data breach.

Who are the class members?

The class members include all individuals residing in the United States whose personal information was compromised in the security incident on July 11, 2022.

How much can class members get?

Class members can claim cash payments for reimbursement of up to $2,500 for "Out-of-Pocket Losses".

Additionally, there is a "Default Settlement Payment" available for those who do not submit a claim for Out-of-Pocket Losses.

Out-of-Pocket Losses include expenses such as late fees, declined payment fees, overdraft fees, returned check fees, customer service fees, card cancellation or replacement fees, credit-related costs, and costs to replace a driver's license, state identification card, or social security number due to fraud plausibly traceable to the Security Incident.

Payments for time spent remedying issues are also available at $20 per hour for up to twenty hours with documentation, or up to five hours with self-certification.

  • Out-of-Pocket Losses: Up to $2,500
  • Default Settlement Payment: Pro-rata shares with California residents receiving three shares and non-Californians receiving one share

What proof is required to submit a claim?

Claimants need to provide reasonable documentation to claim reimbursement for Out-of-Pocket Losses. This includes credit card statements, bank statements, invoices, telephone records, and receipts. Self-certification is allowed for time lost claims up to five hours.

How to claim an award

To claim an award, class members must submit a valid and claim form by January 2, 2025.

$2,425,000 Settlement fund

The settlement fund of $2,425,000 will cover cash payments to class members, the costs of settlement administration, court-approved attorneys' fees and expenses, and service awards for named plaintiffs.

  • Attorneys' Fees: Up to $1,000,000
  • Service Awards: $1,000 to each Class Representative
  • Administration Costs: Deducted from the fund
  • Remaining Funds: Distributed to class members

When is the Somnia Security Incident Settlement payout date?
