Realogy Holdings Corp. has agreed to pay $20 million to settle a class action lawsuit alleging violations of the Telephone Consumer Protection Act (TCPA). The lawsuit claimed that Coldwell Banker-affiliated real estate agents, associated with Realogy Holdings Corp. and its affiliates, made unsolicited calls to consumers whose phone numbers were listed on the National Do Not Call Registry or used prerecorded voice messages without consent.
Who is eligible to file a TCPA settlement claim??
You are a class member if you meet the criteria of one or both of the following categories:
- NDNC Class:
- You received two or more calls within any 12-month period to a residential landline or cell phone number listed on the National Do Not Call Registry for at least 31 days prior.
- The calls were made by Coldwell Banker-affiliated real estate agents using Mojo, PhoneBurner, or Storm dialers.
- The calls occurred between June 11, 2015, and December 3, 2020.
- Prerecorded Messages Class:
- You received at least one call from a Coldwell Banker-affiliated real estate agent using an artificial or prerecorded voice message.
- The call has been identified by specific call disposition codes: "Drop Message" (Mojo dialer), "ATTENDED\_TRANSFER" (Storm dialer), or "VOICEMAIL" (PhoneBurner dialer).
- Calls must have occurred between June 11, 2015, and December 3, 2020.

How much is the class action settlement payout?
Class members can receive a pro rata cash payment, estimated to be $281. Final payment amount will be determined by the number of valid claims filed.
How to claim a TCPA class action payment
To receive a class action rebate, class members must file a claim online or print and mail a completed PDF claim form.

When is the Realogy TCPA settlement payout date?

Why was this class action lawsuit filed?
The lawsuit was filed because plaintiffs alleged that Realogy Holdings Corp. and its affiliates violated the TCPA by making unsolicited calls to phone numbers listed on the National Do Not Call Registry and by using prerecorded voice messages without consent.
