PCLI has agreed to pay $400,000 to settle a class action lawsuit for allegedly failing to implement reasonable security measures to protect private information.
Who are the class members?
Class members include individuals who received notice from PCLI that their private information may have been compromised in the November 2023 data incident.
This includes:
- Individuals whose first and last names, Social Security numbers, dates of birth, medical record numbers, health insurance policy numbers, and medical history information were accessed.
- Those who were notified by PCLI about the data breach.
How much can class members get?
- Out-of-Pocket Losses: Up to $5,000 for documented expenses such as identity theft protection, credit monitoring, and professional services to remedy identity theft.
- Cash Payment: Approximately $150, adjusted based on the settlement fund balance.
If the settlement fund is reduced due to a high number of claims, the cash payment may decrease. The pro rata calculation will adjust the cash payment based on the number of valid claims and the remaining funds.
What proof is needed to file a claim?
Yes, claimants need to provide proof of their out-of-pocket losses. Documentation such as receipts, bank statements, or reports must be submitted to support claims for reimbursement of expenses incurred due to the data incident.
