Frontier Communications Parent, Inc. has agreed to pay $5.64 million to settle a class action lawsuit for alleged failure to adequately protect the personal information of individuals who applied for residential services. The lawsuit claimed that Frontier Communications allowed unauthorized third-party access to sensitive personal information, including names, dates of birth, Social Security numbers, and other personally identifiable information.
Who is eligible for a data breach payment?
You are a class member if: You reside in the United States and received a notification from Frontier Communications around June 2024, informing you that your personal information may have been compromised in the data breach incident detected on or about April 14, 2024.
How much is the Frontier settlement payout?
Claimants have the following options:
- Cash Payment A - Documented Losses: Class members can submit a claim for up to $5,000 in documented losses and expenses. You must provide Eligible expenses include:
- Bank fees (such as overdraft or late fees)
- Fees for credit reports, identity theft protection, or credit monitoring services purchased between January 30, 2023, and the claim deadline.
- Unreimbursed charges traceable to the data breach
- Cash Payment B - Flat Cash Payment: Class members that do not select Cash Payment A (Documented Losses) can submit for a pro rata cash payment estimated at $100. Final payment amount will be determined by the number of valid claims submitted.
- Credit Monitoring: All class members can select to receive two free years of credit monitoring services, at a value of $90 per year.
How to claim a data breach class action rebate
To receive a settlement payment, class members must submit a claim form by the settlement deadline. You will have the option to submit a claim using the online claim form or by printing a pdf claim form and mailing it to the settlement administrator.
The online and pdf claim forms will be made available to class members once the settlement website is live.
Do claims require documentation?
Yes, if you select the Documented Losses option, you must provide proof traceable to the data breach. Acceptable documentation includes:
- Receipts
- Bank statements
- Phone bills
- Credit monitoring service invoices
- Other records clearly showing expenses or unreimbursed charges directly related to the data breach
Payout options
Class members can receive their payments via:
- Electronic payment (PayPal, Venmo, or Zelle) if your claim is submitted online through the settlement website
- Check mailed directly to provided address (only option for mailed claims)
$5.64 Million data breach settlement fund
The $5,640,000 settlement fund will include:
- Attorneys' fees: Up to $1,880,000
- Attorneys' expenses: To be presented to court at a later date
- Service awards to class representatives: Up to $2,500 each.
- Settlement administration costs: To be determined
- Credit monitoring services: Cost determined by number of claims submitted
- Payments to approved claimants: Remaining settlement balance after deducting attorneys' fees, service awards, and administrative costs.
When is the Frontier Communications class action settlement payout date?
Payments will be issued to class members with valid claims after the settlement receives final court approval and any appeals are resolved. The final hearing date will be announced when the settlement website goes live.
