Henry’s Towing Fees $3M Class Action Settlement

If you had your vehicle involuntarily towed from a private parking lot in Montgomery County, Maryland, by HWS LLC, trading as Henry’s Wrecker Service ("Henry’s Towing"), between March 23, 2019, and December 31, 2023, you may be eligible to submit a claim for between $150 and $300 from a class action settlement.

Henry’s Towing has agreed to pay $3 million to settle a class action lawsuit alleging violations of Maryland state laws. The lawsuit claims Henry’s Towing improperly asserted liens against vehicles it towed by refusing to release the vehicles to their owners until all towing fees and charges were fully paid.

Who is eligible for a settlement payout?

You are eligible to file a claim if you meet all of the following criteria:

• Your vehicle was involuntarily towed by Henry’s Towing from a private parking lot in Montgomery County, Maryland.
• The towing event occurred between March 23, 2019, and December 31, 2023.
• You paid a fee to Henry’s Towing to regain possession of your vehicle.
• The vehicle towed was purchased, acquired, or driven for personal, family, household, or agricultural purposes (not commercial or business).

You can file multiple claims if you had more than one vehicle towed during the eligible period or if your vehicle was towed multiple times.

How much will the class action payment be?

Pro Rata Cash Payment: Estimated payment amount is between $150 to $300. Final payment amount will be determined by the number of valid claims filed.

How to claim a class action rebate

To receive a settlement payment, class members must submit a claim form by the deadline of August 4, 2025. You can file a claim online or download and print the PDF claim form to mail to the settlement administrator.

$3 Million class action settlement fund

The $3,000,000 will include

• Settlement administration costs: To be determined
• Attorneys' fees: $1,000,000
• Attorneys' litigation costs: To be presented at a later date
• Payments to valid claimants: Remaining settlement funds after deductions
• Service award to representative plaintiff: Up to $15,000, paid separately from the settlement fund
