If you were identified as a possible match to an entry on the Office of Foreign Asset Control’s List of Specially Designated Nationals by National Credit Center, LLC (NCC) between May 5, 2020, and June 11, 2024, you may be eligible to claim an award ranging from $38 to $1,500 from a class action settlement.
National Credit Center, LLC has agreed to pay $30,000,000 to settle a class action lawsuit for allegedly providing inaccurate OFAC screens to its customers, which misidentified individuals as possible matches to the OFAC List. This list, maintained by the U.S. Department of the Treasury, includes individuals and entities such as terrorists and narcotics traffickers with whom U.S. businesses are prohibited from conducting business.
Who are the class members?
To be a part of the settlement class, you must meet the following criteria:
- Between May 5, 2020, and June 11, 2024, NCC sold a report to a third party that identified your name as similar to a person or entity on the OFAC List.
- Being a member of the Settlement Class does not mean you are actually listed on the OFAC List.
The class is divided into groups based on the harm experienced:
- Group 1: Individuals who were identified as possible matches but did not experience particularized harm.
- Group 2: Individuals who experienced significant emotional distress or transaction issues due to the NCC OFAC Screen.
How much can class members get?
Class members can receive a Pro Rata Award payment estimated between $38 and $42. Those who experienced particularized harm may file a Claim Form to receive an Actual Damages Award of up to $1,500.
- Pro Rata Award: Estimated $38 - $42. This is for all class members.
- Actual Damages Award: Up to $1,500 for those who experienced significant emotional distress or transaction issues due to the NCC OFAC Screen.
The Pro Rata Award is calculated based on the total settlement fund divided by the number of valid claims. For example, if the net settlement fund is $20,000,000 and there are 500,000 valid claims, each claimant would receive $40.
What information or documents are required to file a claim?
Yes, claimants need to provide proof of harm caused by the NCC OFAC Screen to claim an Actual Damages Award:
- Identifying the recipient of the NCC OFAC Screen.
- Describing the harm experienced, such as emotional distress or transaction delays.
- Providing supporting documentation if available.

How is the settlement fund distributed?
