If your private information was compromised due to one of the two data incidents involving MGM Resorts International in July 2019 or September 2023, you may qualify to submit a claim for up to $15,000 from a class action settlement.

MGM Resorts International has agreed to pay $45 million to settle a class action lawsuit for alleged unauthorized access to customer private information, including names, addresses, and Social Security numbers due to two different data breach incidents.

Who is eligible for an MGM data breach payment?

The settlement class includes the following:

  • Individuals in the United States whose private information was compromised in one or both of the data breach incidents.
  • Individuals who were sent notice by MGM of the data breaches.

How much will the MGM class action settlement payout be?

Class members can submit a claim for one or more of the following:

  • Financial Account Monitoring: One year of three-bureau credit and financial account monitoring, along w
  • Documented Loss Cash Payment: Up to $15,000 for documented financial losses related to the data incidents.
  • Pro Rata Cash Payment: Amount determined by private information exposed in the breach and the number of valid claims filed.
    • Tier 1 Cash Payment: Estimated $75 if your Social Security number or military identification number was exposed.
    • Tier 2 Cash Payment: Estimated $50 if your passport number or driver’s license number was exposed.
    • Tier 3 Cash Payment: Estimated $20 if your name, address, and/or date of birth was exposed.

How to claim a data breach settlement payment

To claim a data breach payout, class members must submit claim form by the May 19, 2025 deadline. You can file a claim online or print the PDF claim form and mail it to the settlement administrator.

Required proof

  • Unique ID and PIN required to submit online claim.
    • According to the settlement website, notices to class members will be issued through April 2025.
  • Documented Loss Cash Payment: Requires receipts, bank and credit card statements, invoices, and other documentation showing financial loss due to one or both of the data breaches.

  • Digital debit card
  • PayPal
  • Paper check mailed to address providing

$45 Million data breach settlement fund

The settlement fund of $45,000,000 will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees and expenses: Up to $13,500,000
  • Service awards to class representatives: $10,000 each for those that gave depositions, $3,500 for others
  • Financial Monitoring Services: To be determined
  • Payments to approved claimants: Amounts determined by number of valid claims

  • Final Approval Hearing: June 18, 2025

When is the MGM Data Incident payment date?

The final hearing is currently scheduled for June 18, 2025. Once the court grants the settlement approval, the administrator will process claims and issue payments to approved class members.

Why was there a class action settlement?

The lawsuit was filed due to unauthorized access to MGM's network, compromising customer private information due to two separate data breaches. The settlement was reached to avoid the costs and risks of continued litigation and a possible trial.
