If your patient information was compromised in a data security incident involving LivaNova USA, Inc., you may be eligible to claim up to $5,000 from a class action settlement.

LivaNova USA, Inc. has agreed to pay $1.205 million to settle a class action lawsuit for alleged negligence in their data security practices, which led to unauthorized access to private patient information.

Who qualifies to receive a payment?

The Settlement Class includes all individuals in the United States whose private information was potentially compromised due to the Data Security Incident.

This includes:

  • Individuals in the United States whose names, contact information, Social Security numbers, dates of birth, medical information, and health insurance information were exposed.
  • Patients that were notified by LivaNova that their personal information may have been compromised in a 2023 cybersecurity incident.

What type of payout am I eligible for?

Class members can claim the following:

  • Documented Losses Cash Payment: Up to a $5,000 reimbursement for documented financial losses directly related to the incident. Losses may include financial damage due to fraud or identity theft, fees and costs associated with credit damage and protection measures, and miscellaneous expenses.
  • Flat Cash Payment: Currently estimated at $100, subject to pro rata adjustments based on the number of approved claims.
  • Credit/Data Monitoring Services: Approved claimants may submit for up to three years of credit monitoring.

How do I claim my settlement payment?

To claim a payment, class members must submit a claim form by March 20, 2025. You can file a claim online or download the PDF claim form from the settlement website and mail it to the settlement administrator.

Do I need to provide proof in order to collect a payout ?

Proof is required for:

  • Claim Number and PIN from notice is required to submit a claim, according to the settlement website
  • Documented Loss claims require proof such as receipts, bank statements, explanation of expects, ect.
  • Additional documentation is not required for claimants submitting only for the Flat Cash Payment and/or Credit Monitoring

$1.21 Million Settlement fund breakout

The settlement fund of $1.205 million will cover various costs and payments:

  • Payments to class members and credit monitoring: TBD
  • Settlement administration costs: TBD
  • Attorneys' fees and expenses: Up to 33.33% of the settlement fund, approximately $401,666.67
  • Service awards to class representatives: $2,500 each

When is the LivaNova Data Breach Settlement payout date?

Payments will be issued after the final approval hearing on April 4, 2025 takes place, approval is granted, and any appeals are resolved.

Why did LivaNova settle?

The class action alleged that LivaNova was negligent in its data security practices, leading to a breach of private patient information. LivaNova denies wrongdoing but agreed to settle to avoid the costs and risks of continued litigation and a possible trial.
