If you purchased a product or service from Everlywell or Natalist between April 2019 and December 3, 2024, you may be eligible to claim a cash payment from a class action settlement.

Everlywell, Inc. has agreed to pay $5,000,000 to settle a class action lawsuit for allegedly disclosing confidential information to third parties without consent.

Who is eligible for a settlement payout?

The settlement class is divided into two subclasses, each with specific criteria:

  • Non-Sensitive Test Subclass Members: This group includes 1,340,000 individuals who used Everlywell or Natalist websites to purchase test kits and other products not classified as sensitive.
  • Sensitive Test Subclass Members: This subclass consists of 660,000 individuals who purchased tests classified as "sensitive", such as those for sexually transmitted infections, from the same websites.

How will my payment be?

The settlement fund totals $5,000,000, which is divided into two parts for distribution among class members:

  • Non-Sensitive Test Subclass Members: A fund of $2,360,000 is allocated to this group. After costs and fees, members will receive a pro rata share of the remaining funds.
  • Sensitive Test Subclass Members: This group has $2,640,000 settlement fund. Similarly, after deductions, members will receive a pro rata payment.

The exact amount each claimant will receive depends on the number of valid claims and the remaining funds after fees, expenses, and awards.

How do I claim my payout?

To claim a payment, you must complete and submit a claim form. You can file a claim online or download the Non-Sensitive Test PDF claim form or the Sensitive Test PDF claim form and mail it to the settlement administrator.

Do I need to provide supporting documentation to receive a payment?

The Class Member ID listed on the notice sent to class members is required to submit online or must be included on the mail-in claim form. Purchase documentation is not required.

Claim instructions

  1. Visit the settlement website and access the online claim form or print the mail-in form.
  2. Fill out your Class Member ID and personal information.
  3. Choose your preferred payment method.
  4. Submit the form online or mail it by the claim deadline of March 19, 2025

Class members will select from the following payment options:

  • Electronic transfer
  • Check by mail

$5 Million settlement fund

The settlement fund of $5,000,000 will cover:

  • Notice and settlement administration costs
  • Attorneys' fees and expenses
  • Service awards to class representatives
  • Pro rata payments to class members
  • 47.2% of fees and costs will come from the Non-Sensitive Test settlement fund. 52.8% will come from the Sensitive Test settlement fund.

When is the Everlywell Settlement payout date?

Payments will be made after the final approval hearing and any appeals are resolved.

Why is there a class action settlement?

The lawsuit alleges that Everlywell and Natalist used tracking tools on their websites, which resulted in the unauthorized disclosure of personal information to third parties like Meta and Google. The settlement avoids the costs and risks of a trial.

What happens next?

After the final approval hearing takes place on April 29, 2025, if the judge approves the settlement, claim review will take place and payments will be distributed to valid claimants. Appeals can delay the payment process.
