Who are the class members?
To be considered a class member, you must be one of the 160,000 people who received a consumer notification letter from Eskenazi Health that your personal information was posted on the dark web.
How much can class members get?
Class members can claim several forms of compensation:
- Reimbursement for Out-of-Pocket Losses: You can claim up to $5,000 for expenses incurred due to the data incident. This includes bank fees, phone charges, data charges, and other miscellaneous expenses like postage and notary fees. You must provide documentation to support your claim.
- Reimbursement for Lost Time: You can claim up to $80 for time spent dealing with the data incident, calculated at $20 per hour for up to 4 hours. You need to attest to the time spent and describe the activities.
- Pro Rata Cash Payment: This payment is calculated based on the number of valid claims submitted. The remaining Net Settlement Fund, after other claims are paid, will be divided among claimants. For example, if $1,000,000 remains and 10,000 valid claims are submitted, each claimant would receive $100.
- Identity Theft Protection Services: You can receive three years of credit monitoring and identity theft protection services, including $1,000,000 in identity theft insurance, at no cost.
