If you purchased EpiPen or its generic version directly from Mylan or Teva for resale, you may qualify to submit a claim for a portion of a $73.5 million class action settlement.
Mylan has agreed to pay to settle allegations of engaging in improper market allocation agreements with Pfizer and Teva, which allegedly delayed the launch of a generic EpiPen and extended their monopoly over the epinephrine autoinjector market.
Who is eligible for an EpiPen payout?
To qualify to submit a claim you must meet specific criteria:
- You must be a person or entity in the United States, its territories, possessions, or Puerto Rico.
- Individuals or entities must have purchased EpiPen or generic EpiPen directly from Mylan or Teva for resale.
- EpiPen purchases must have occurred between March 13, 2014, and February 6, 2025.
How much is the class action settlement payment?
- The court approved Plan of Allocation proposes distributing remaining settlement funds after costs and expenses based upon the number and cost of purchases made during the Class Period.
- The number of approved claims will determine final payment amount.
How to claim a EpiPen settlement payout
To receive a payment, class members must submit a valid claim by the May 29, 2025 deadline. You can file a claim online or print a PDF claim form to complete and mail to the settlement administrator.

- Attorneys' fees: Up to $24,500,000 plus interest
- Attorneys' expenses: To be approved by the court at a later date
- Payments to approved claimants: The remaining settlement amount plus interest after costs and fees

When is the EpiPen settlement payout date?
There is a Fairness Hearing scheduled for May 9, 2025. The court must grant final approval to the settlement before payments are issued. Once final approval is granted, payments will be distributed to valid claimants.
Why is there a class action settlement?
The lawsuit alleged that Mylan engaged in improper market allocation agreements with Pfizer and Teva, which delayed the introduction of a generic EpiPen and extended their monopoly over the market. Mylan denies any wrongdoing but agreed to the settlement to avoid the costs and risks of continued litigation.
