If you are a resident of the United States and received a notice of a data incident from BHI Energy Services, LLC and BHI Energy I Specialty Services LLC, you may be eligible to claim up to $7,500 from a class action settlement.
BHI Energy has agreed to pay $1,500,000 to settle a class action lawsuit for alleged data breach incidents that compromised private information between May 30, 2023, and July 7, 2023.
Who can file a claim?
To be part of the Settlement Class, you must meet the following criteria:
- You are a U.S. resident.
- You received a breach notice letter from BHI that was not returned as undeliverable.
- Your private information was compromised in the data incident.
The Settlement Class also includes a California Subclass, specifically for California residents who received a breach notice.
How much can class members get?
Class members can claim various benefits, depending on their claim(s):
- Reimbursement for Lost Time: Up to 4 hours at $25 per hour.
- Out-of-Pocket Losses: Up to $7,500 for documented expenses related to the data breach.
- CCPA Payment: $100 for California Subclass Members.
- Pro Rata Cash Payment: Based on remaining funds after other claims are paid.
- Credit Monitoring and Identity Protection: 24 months of services, including identity theft insurance and real-time credit monitoring.
The pro rata cash payment will depend on the number of claims and the remaining funds in the settlement pool. For example, if $200,000 remains after other claims and 2,000 people apply for the pro rata payment, each would receive $100.
How to file a claim
Class members must submit a claim form by June 12, 2025 to receive benefits. Class members can file a claim online or mail the claim form received by mail to BHI Energy Services Data Breach Settlement c/o Atticus Administration, PO Box 64053, St. Paul, MN 55164.
Claimants need to provide proof of their out-of-pocket expenses and losses.

- Lost Time: An attestation that the time was spent addressing the data breach.
