BHG XXXIV, LLC and BHG Holdings, LLC have agreed to pay $1,575,000 to settle a class action lawsuit for alleged negligence, breach of contract, and other claims related to a data incident that occurred on or about December 5, 2021.

You are a Settlement Class Member if BHG possesses your address and your personal information may have been compromised in the data incident. Additionally, you are part of the Injunctive Relief Class if your personally identifiable information was impacted.
- Settlement Class Members: Eligible for monetary compensation and credit monitoring services.
- Injunctive Relief Class Members: Only eligible for non-monetary benefits.
What Awards Can Class Members Claim?
The settlement provides several types of compensation for eligible class members:
Settlement Class Members can choose between an Alternative Cash Payment or compensation for unreimbursed losses, lost time, and/or credit monitoring services.
- Alternative Cash Payment: Estimated at $150 but could range up to $250 depending on the number of claims and remaining funds after other distributions.
- Compensation for Lost Time: Up to 8 hours at $25 per hour for time spent dealing with the data incident.
- Ordinary Out-of-Pocket Expenses: Up to $200 for documented expenses such as bank fees, phone charges, postage, and credit monitoring services purchased between December 5, 2021, and October 22, 2024.
- Extraordinary Out-of-Pocket Expenses: Up to $5,000 for documented losses directly arising from identity theft or fraud resulting from the data incident.
- Credit Monitoring Services: 24 months of free credit monitoring and identity theft protection services.
For example, if a class member claims 8 hours of lost time, they would receive $200 (8 hours x $25/hour). If they also incurred $150 in ordinary out-of-pocket expenses, they could claim a total of $350, provided they did not opt for the Alternative Cash Payment.
Is Proof Required to Claim the Reward?
Yes, claimants need to provide proof of their losses to claim compensation for unreimbursed losses.

- Documentation of ordinary losses such as bank statements, phone bills, and receipts.
