Sunrise Senior Living $18.2M Staffing Claims Settlement

If you or a loved one lived in a Sunrise Senior Living facility in California between June 27, 2013, and August 22, 2024, you may be eligible to claim a monetary award from a class action settlement.

Sunrise Senior Living has agreed to pay $18,200,000 to settle a class action lawsuit for allegedly misleading consumers about the staffing levels at its facilities.

Who are the class members?

The settlement class includes individuals who resided at a Sunrise California Community between June 27, 2013, and August 22 and who contracted with and paid money to Sunrise under a Residency Agreement.

• Sunrise at Belmont
• Sunrise at Beverly Hills
• Sunrise at Bonita
• Sunrise at Burlingame
• Sunrise at Canyon Crest
• Sunrise at Carmichael
• Sunrise at Claremont
• Sunrise of Cupertino (from October 1, 2023)
• Sunrise of Orange (from April 27, 2023)
• Sunrise of San Rafael (from September 29, 2016)
• And many more across California

How much can class members get?

The payment consists of a Base Payment of $500 plus an additional Residency Days Payment calculated based on the number of days the class member resided at a Sunrise facility during the class period.

The Net Settlement Fund, estimated to be approximately $5 million, will be distributed among the class members. The exact amount each member receives will depend on the number of eligible days they resided at a facility.

For example, if a class member lived in a facility for 100 days, their payment would be $500 plus an additional amount based on the Residency Days Payment calculation.

No action needed to receive compensation

If you are a class member and your mailing address is correct, you do not need to take any action. Your cash payment will be mailed to you once the settlement is approved and becomes effective.

$18,200,000 Settlement fund

The settlement fund of $18,200,000 will cover various expenses, including:

• Class notice and settlement administration expenses up to $75,000
• Class Counsel's attorneys' fees up to $10.9 million
• Class Counsel's litigation expenses up to $2 million
• Service awards of $15,000 to each Class Representative
• A Late Claims Reserve of $25,000

The remaining amount, approximately $5 million, will be distributed to class members.

When is the Sunrise Senior Living payout date?

The Final Approval Hearing is on November 8, 2024. If the settlement is approved, payments will be distributed to class members within 30 days after the Court grants final approval and the time for appellate review has passed.
