If you purchased or leased a 2019–2022 Subaru Ascent, Forester, Legacy, or Outback, you might be eligible to claim compensation from a class action settlement.

Subaru of America, Inc. has agreed to settle a class action lawsuit concerning alleged defects in the windshields of these vehicles, which are claimed to crack more frequently or easily than expected.

Who can submit a claim?

To be considered a class member eligible to submit a claim:

  • You are a resident of the continental United States, Alaska, or Hawaii.
  • You currently own or lease, or previously owned or leased, a 2019–2022 Subaru Ascent, Forester, Legacy, or Outback.
  • The vehicle must have been originally purchased or leased in the continental United States, Alaska, or Hawaii.

Who is excluded?

The following are excluded from the class:

  • Current employees, officers, directors of Subaru, and their immediate family members.
  • Used car dealers and those who purchased a vehicle solely for resale.
  • Vehicles with a salvaged title or acquired as a result of a total loss.
  • Issuers of extended vehicle warranties and service contracts.

How much can class members get?

Class members can receive two main benefits:

  1. Extended Warranty: Subaru will extend its existing express New Vehicle Limited Warranty to cover qualifying windshield cracks for eight years or 100,000 miles, whichever occurs first, from the vehicle's in-service date. This warranty is limited to a one-time replacement of the original windshield with an updated part.
  2. Cash Reimbursement: Class members may receive cash reimbursement for out-of-pocket expenses incurred for parts and labor associated with repairing a qualifying windshield crack. These costs must have been incurred prior to or within 45 days following the notice date and before the expiration of the extended warranty period.

The extended warranty covers all parts and labor costs associated with the replacement of the windshield due to a qualifying crack, performed by an authorized Subaru dealer, and includes calibration of the Subaru EyeSight® driver assist system.

How to file a claim

To claim an award, you must submit a claim electronically through the online claim form by January 31, 2025. Alternatively, claims can be mailed to Subaru Windshield Settlement, c/o JND Legal Administration, P.O. Box 91330, Seattle, WA 98111.

Claimants must provide proof of out-of-pocket payments for parts and labor associated with a qualifying windshield repair. Acceptable documentation includes:

  • Receipts
  • Credit card statements
  • Bank statements
  • Invoices
  • Historical accounting records

When is the Subaru Windshield Settlement payout date?

Why was there a class action settlement?
