If you are a resident of the United States whose information was accessed in the Data Security Incident disclosed by See Tickets in September 2023, you may be eligible to claim up to $100 from a class action settlement.

Vivendi Ticketing US LLC, doing business as See Tickets, has agreed to pay $3,250,000 to settle a class action lawsuit for alleged negligence and breaches of contractual and statutory duties related to a data security incident.

Can I Claim an Award?

To be eligible for an award, you must be a resident of the United States whose information was accessed in the Data Security Incident and you received notice of the Data Security Incident from See Tickets. This means that if you were affected by the unauthorized access to payment card information disclosed by See Tickets in September 2023, you are likely a Settlement Class member.

Settlement Class members include:

  • Residents of the United States whose information was accessed in the Data Security Incident.
  • Individuals who received notice of the Data Security Incident from See Tickets.

What Awards Can Class Members Claim?

Settlement Class members can claim one of the following awards:

  • Three years of three-bureau Credit Monitoring Services.
  • A pro rata Alternative Cash Payment of up to $100 from the funds remaining in the Net Settlement Amount after payment of the Credit Monitoring Services and other awards.

Additionally, Settlement Class members who incurred expenses as a result of the Data Security Incident may be eligible for reimbursement:

  • Reimbursement of up to $2,000 in ordinary documented out-of-pocket expenses, such as unreimbursed bank fees, interest on short-term loans, long-distance phone charges, cell phone charges (if charged by the minute), data charges (if charged based on the amount of data used), postage incurred, or gasoline for local travel.
  • Reimbursement of up to $5,000 in documented extraordinary expenses incurred from identity theft more likely than not caused by the Data Security Incident.

California residents are entitled to an additional $100 California Statutory Award.

Is Proof Required to Claim the Reward?

Yes, proof is required to claim the reward. Claimants need to provide documentation to establish their eligibility for reimbursement of expenses. This includes:

  • Bank statements showing unreimbursed bank fees.
  • Receipts for credit reports, credit freezes, or credit monitoring services purchased in response to the Data Security Incident.
  • Documentation of extraordinary expenses incurred from identity theft.

How to Claim Your Award

To claim your award, you must submit a completed Claim Form by October 20, 2024. You can submit a Claim Form online or by mailing it to the Settlement Administrator at:

Submitting a Claim

Follow these steps to submit a claim:

  1. Visit the online claim form at this link.
  2. Enter your Claimant ID or email address and name.
  3. Fill out the required information, including your mailing address, telephone number, and email address.
  4. Select whether you want the credit monitoring services or the alternative cash payment.
  5. Provide documentation for any expenses you are claiming for reimbursement.
  6. Sign and date the form electronically.
  7. Submit the form online or mail it to the Settlement Administrator.

How do I Get Paid?

Payments will be issued via check to the mailing address provided in your Claim Form. If you choose the credit monitoring services, you will receive an activation code to enroll in the services.

$3,250,000 Settlement Fund Breakdown

The total settlement amount is $3,250,000. This fund will be used to cover:

  • Class Counsel Fees and costs.
  • Service payments for the Named Plaintiffs.
  • Administrative costs.
  • Payments to eligible Settlement Class members.

After deducting the amounts for Class Counsel Fees, service payments, and administrative costs, the remaining amount will be used to pay timely valid claims.

Why is There a Class Action Settlement?

The settlement resolves allegations that See Tickets was negligent and breached contractual and statutory duties in connection with a data security incident. By settling, See Tickets does not admit any wrongdoing but agrees to pay the settlement amount to avoid the expense, delay, and uncertainty of litigation.

What Happens Next?

Next, the Court will hold a Final Approval Hearing on December 16, 2024, to determine the fairness of the settlement. If approved, payments will be distributed to eligible Settlement Class members.
