    • $6.9 million settlement
  • HomeSmart Holdings, Inc. (“HomeSmart”)

  • Five D I, LLC (d/b/a United Real Estate)
    • $3.75 million settlement
  • Premiere Plus Realty, Co., Charles Rutenberg Realty - Orlando, LLC (“CRR-Orlando”)
    • $3.75 million settlement

These Gibson defendants have agreed to collectively pay $110,000,000 to settle a class action lawsuit for alleged anticompetitive practices that inflated commission rates paid by home sellers.

This settlement is part of a larger series of settlements totaling over $730 million involving man real estate brokerages.

Who Can File a Claim?

To be part of the settlement class, you must meet the following criteria:

  • Listed the home on a multiple listing service (MLS) anywhere in the United States.
  • Paid a commission to a real estate brokerage in connection with the sale of the home.
  • Sold a home during the "eligible date range", which varies depending on the MLS used, but generally includes sales from October 31, 2019, through July 23, 2024.
    • Specific date ranges for different states are as follows
    • Alabama, Georgia, Indiana, Maine, Michigan, Minnesota, New Jersey, Pennsylvania, Tennessee, Vermont, Wisconsin, or Wyoming: October 31, 2017, through July 23, 2024
    • Nevada: January 15, 2018, through July 23, 2024
    • Arkansas, Kentucky, or Missouri: October 31, 2018, through July 23, 2024
    • California: October 2, 2019, through July 23, 2024
    • Anywhere else in the United States: October 31, 2019, through July 23, 2024

How Much Can Class Members Get?

The amount class members will receive is still yet to be determined. The court will approve a Plan of Allocation that will set the calculations and details of the settlement awards.

The settlement fund will be distributed among qualifying class members who submit approved claims.

The exact amount each class member can receive will depend on the total number of valid claims submitted and the total settlement fund available.

Is Proof Required to Submit a Claim?

Yes, claimants need to provide proof of their home sale and the commission paid. This can include closing statements, settlement statements, or other transaction documents.

How to Claim an Award

To claim your award, you can file a claim online through the online claim form or by mailing your completed claim form to the settlement administrator. The mailing address is:

Claim Instructions

  1. Visit the online claim form to submit your claim electronically.
  2. If you prefer to mail your claim, download and print the claim form from the settlement website.
  3. Complete all required sections of the claim form, including details about your home sale and the commission paid.
  4. Attach any supporting documents, such as closing statements or settlement statements.
  5. Mail the completed claim form and supporting documents to the settlement administrator at the address provided above.

$57,500,000 settlement fund

The settlement fund of $57,500,000 will cover:

  • Attorneys' fees (up to one-third of the settlement fund)
  • Settlement administration costs
