If you are a woman who worked for Oracle America, Inc. in California between June 16, 2013, and April 22, 2024, you may be eligible to claim an award from a class action settlement.

Oracle America, Inc. has agreed to pay $25,000,000 to settle a class action lawsuit for alleged violations of California's Equal Pay Act and Unfair Competition Law. The lawsuit claims that Oracle unlawfully paid women less than men for performing substantially similar work and had a practice of relying on prior pay to determine starting pay, which allegedly had a disparate impact on women.

Who Can Claim an Award?

The settlement class includes:

  • Who: all women employed by Oracle in California
  • Which Roles: Information Technology, Product Development, and Support job functions
    • Excluding: campus hires and managerial positions
  • When: from June 16, 2013 through April 22, 2024.

Those who fall within this definition are members of the settlement class and eligible to claim an award.

Those who received a notice via mailed, it is because they were listed in Oracle’s records as a Settlement Class Member.

What Awards Can Class Members Claim?

The total settlement fund is $25,000,000. After deducting costs for settlement administration, attorneys' fees, litigation and expert costs, and service awards to the named plaintiffs, the remaining amount will be distributed to class members.

The net settlement fund, approximately $15,011,600, will be allocated to class members based on their total compensation earned during the class period. The formula for calculating individual awards is:

  • Pro Rata Share: Total Compensation Earned by Settlement Class Member ÷ Aggregate Total Compensation Earned by All Settlement Class Members

For example, if a class member earned $500,000 over three years and the aggregate total compensation for all class members is $2 billion, their share of the net settlement amount would be 0.025%. If the net settlement fund is $15 million, the class member's award would be $3,750. Note this is an hypothetical example, not reflective of actual figures, and settlement awards will vary.

Is Proof Required to Claim the Reward?

The lawsuit claims that Oracle unlawfully paid women less than men for performing substantially similar work and had a practice of relying on prior pay to determine starting pay, which allegedly had a disparate impact on women. Oracle denies these allegations but has agreed to settle to avoid the risks and costs of continued litigation.

What Happens Next?

The court will hold a fairness hearing on October 7, 2024, to decide whether to approve the settlement. If approved, the settlement administrator will distribute the awards to class members.
