If you were notified by Nonstop Administration and Insurance Services, Inc. about a data breach, you may be eligible to claim up to $5,000 from a class action settlement.

Nonstop Administration and Insurance Services, Inc. has agreed to pay $1,600,000 to settle a class action lawsuit stemming from a 2023 data breach.

Who are the class members?

  • Nationwide Class Members: Individuals within the United States whose protected health information (PHI) or personally identifiable information (PII) was exposed due to the data breach discovered on December 22, 2022.
  • California Subclass Members: Individuals residing in California whose PHI/PII was exposed.

How much can class members get?

  • Out-of-Pocket Losses: Up to $5,000 per person for documented expenses directly related to the breach. This includes unreimbursed costs for addressing identity theft, fraud, or misuse of personal information.
  • Alternative Cash Payment: An estimated $50, subject to pro rata adjustments based on the remaining settlement funds after other expenses.
  • California Statutory Payment: $100 for California residents, also subject to pro rata adjustments.

The pro rata calculation ensures that if the total claims exceed the available funds, each claimant receives a proportionate share of the remaining funds. For example, if there are $500,000 remaining in the settlement fund and 10,000 claimants, each would receive $50.

To claim an award, class members must submit a claim form by February 12, 2025. Claims can be filed online through the online claim form or by mailing a completed form to the settlement administrator. The claim form is also available in PDF format.
