_Editors note__: The NAR settlement is one of three separate settlements in the cases collectively known as the "Real Estate Commission Litigation" class action lawsuits. Read about the other two: Gibson Settlement and Burnett Settlement._
If you sold a home and paid a commission to a real estate agent, you may be eligible to claim a portion of the $418,000,000 settlement from a class action settlement.
The National Association of Realtors (NAR) has agreed to pay $418,000,000 to settle a class action lawsuit for alleged anticompetitive practices that led to inflated commission rates for home sellers.
Who are the class members?
To be part of the settlement class, you must meet the following criteria:
- Sold a home during the eligible date range.
- Listed the home on a multiple listing service (MLS) anywhere in the United States.
- Paid a commission to a real estate brokerage in connection with the sale of the home.
The eligible date range varies based on the MLS used for listing. For example, homes listed on Heartland MLS, MARIS MLS, Columbia Board of Realtors MLS, or Southern Missouri Regional MLS between April 29, 2014, and August 17, 2024, are eligible. Other MLSs have different date ranges, such as March 6, 2015, through August 17, 2024, for Bright MLS and others.
How much can class members get?
The settlement fund will be distributed to qualifying class members who submit an approved claim form. The exact amount each class member can receive will depend on the number of claims submitted and approved. The settlement fund, after deducting attorneys' fees, expenses, and other costs, will be divided among the class members.
Is proof required to submit a claim?
Yes, claimants need to provide proof to claim an award. Claimants must submit a claim form with information and/or evidence of their home sale and commissions paid.
How to claim an award
To claim an award, class members must submit a claim form by May 9, 2025. You can file a claim online by visiting the online claim form or by mailing the form to the settlement administrator at the following address:
