If you had a Missouri property insured by State Auto Property and Casualty Company, State Auto Mutual Insurance Company, or Meridian Security Insurance Company, and you submitted a claim for structural damage between June 15, 2012, and October 31, 2022, you may be eligible to claim a payment ranging from $25 to potentially thousands of dollars from a class action settlement.

State Auto has agreed to pay to settle a class action lawsuit alleging that the company improperly deducted nonmaterial depreciation when adjusting structural loss claims in Missouri. Although State Auto denies any wrongdoing, the parties agreed to settle the lawsuit to avoid the costs and uncertainties of continued litigation.

Who is eligible for a settlement payment?

Class members must meet all of the following criteria:

  • You held a Missouri insurance policy issued by State Auto Property and Casualty Insurance Company, State Auto Mutual Insurance Company, or Meridian Security Insurance Company.
  • You submitted a claim for structural damage to your insured property between June 15, 2012, and October 31, 2022.
  • A Symbility or Xactimate estimate was used in determining the value of your claim.
  • Nonmaterial depreciation was withheld from your claim payment, or withholding nonmaterial depreciation caused your claim to fall below your deductible, resulting in no payment.

Excluded policyholders

You are not eligible to participate in this settlement if you fall into any of these categories:

  • Policyholders whose policies explicitly permitted nonmaterial depreciation deductions.
  • Policyholders who received actual cash value (ACV) payments that exhausted their policy limits.
  • Policyholders whose claims were denied or abandoned for reasons other than nonmaterial depreciation causing the loss to fall below the deductible.
  • Policyholders whose claims did not involve estimates from Symbility or Xactimate software.

How much is the class action payout?

The settlement payments will be based on the amount of nonmaterial depreciation withheld from your claim.

  • Category 1 is Nonmaterial depreciation withheld and never paid:
    • Claimants will receive 90% of the withheld nonmaterial depreciation amount.
    • Claimants will also receive 5% simple interest per year calculated from January 1 of the year your loss was reported through December 31, 2024.
  • Category 2 is Nonmaterial depreciation withheld but later reimbursed to the policyholder:
    • Claimants will receive a flat cash payment, amount determined by the Nonmaterial depreciation withheld:
      • $1 - $5,000: $25
      • $5,001 - $10,000: $50
      • $10,001 - $20,000: $100
      • $20,001 - $40,000: $200
      • $40,001 - $60,000: $300
      • $60,001 - $80,000: $400
      • Greater than $80,000: $500

How to claim a class action rebate

To receive a settlement payment, you must submit a claim form no later than the deadline of July 7, 2025. You can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Class members with multiple covered loss insurance claims must submit a separate claim form for each loss.

Required information and proof

  • Unique ID and PIN required to submit an online claim.
  • State Auto policy number, claim, number, and insured address required for claim.
  • Claimants filing on behalf of a deceased or incapacitated policyholder must provide supporting documentation showing they are a legally authorized representative
  • Claimants that had their claim assigned to a contractor must provide a copy of the agreement.

Payment options

Settlement payments will be issued by check, mailed to the address provided.

Insurance class action settlement fund breakdown

The settlement fund allocation is as follows:

  • Payments to approved claimants: Amount determined by number of valid claims
  • Settlement administration costs: Paid separately by State Auto
  • Attorneys' fees and expenses: Up to $1,250,000
  • Service award to class representative: Up to $7,500

Important dates

  • Deadline to File a Claim: July 7, 2025
  • Deadline to Exclude Yourself: April 21, 2025
  • Final Approval Hearing: May 21, 2025 at 8:30 a.m.

When is the State Auto class action settlement payout date?

The final hearing will take place on May 21, 2025. Once the court grants final approval to the settlement, claims will be processed and payments will be issued to class members with valid submissions.

Why did State Auto agree to settle?

The class action lawsuit claimed State Auto improperly deducted nonmaterial depreciation from structural loss claims. Although State Auto denies wrongdoing, the parties agreed to settle to avoid the expense of continued litigation.
