Who can claim a payout?

You are eligible to file a claim if you meet all of the following criteria:

  • You purchased Feel Free Wellness Tonic containing kratom.
  • Your purchase occurred within the United States.
  • Your purchase took place between March 28, 2019, and March 5, 2025.

To participate in the settlement and receive compensation, you must submit a valid claim form by June 3, 2025.

How much are the payouts

The total settlement fund is $8.75 million. After deducting attorneys' fees, litigation expenses, settlement administration costs, and service awards, the remaining amount will be distributed among eligible claimants.

Payments will be made on a pro-rata basis, meaning the exact amount each claimant receives depends on the total number of valid claims submitted and the number of bottles each claimant purchased.

Claimants can request compensation based on the number of bottles purchased:

  • Claims of 10 bottles or fewer: You can claim compensation without providing any proof of purchase.
  • Claims exceeding 10 bottles: You must provide proof of purchase, such as receipts or other documentation verifying each purchase.

Payout options

Payments will be issued by check mailed directly to your provided address.

$8.75 Million settlement fund

The settlement fund of $8.75 million will cover several expenses and payments, including:

  • Settlement administration costs: Estimated up to $222,169
  • Attorneys' fees: Up to $2,916,666 (one-third of the total fund)
  • Attorneys' expenses: Up to $35,000
  • Service awards to class representatives: Up to $5,000 each
  • Payments to class members: Remaining balance after all deductions

Any funds remaining after all claims are paid will be donated to the Western Center on Law and Poverty.

When is the Botanic Tonics Settlement payout date?

Why did Botanic Tonics agree to settle?

Botanic Tonics chose to settle this lawsuit to avoid the uncertainties, costs, and time associated with ongoing litigation. Although the company denies any wrongdoing, the settlement allows affected consumers to receive compensation without the delays and risks of a trial.

Additionally, as part of the settlement agreement, Botanic Tonics will now include clear warnings on product labels and social media advertisements regarding potential health risks associated with kratom consumption

This warning will state:

> "Warning: This product contains leaf kratom which can become habit-forming and cause serious adverse health effects. Consider avoiding this product if you have a history of substance abuse."
