If you received a text message from Designer Brands, Inc. and/or DSW Shoe Warehouse promoting their products and services after you had requested to stop receiving such messages, you may be eligible to submit a claim for up to $70 from a class action settlement.
Designer Brands has agreed to pay $4,429,180 to settle a class action lawsuit for alleged violations of the Telephone Consumer Protection Act (TCPA) by sending marketing text messages to consumers who had opted out.
Who is eligible for a TCPA payout?
To be part of the settlement class, you must meet the following criteria:
- While in the United States you received a marketing text message from Designer Brands and/or DSW, between September 1, 2018, and September 1, 2024.
- The text message was sent after you had requested not to receive future marketing messages, or opted out.
How much is the DSW Shoe Warehouse settlement payment?
Pro Rata Cash Payment: Class members who submit a valid claim will an estimated payment of $70. Final payout amounts will be determined by the number of approved claims filed.
How to claim a class action payout
To claim a TCPA settlement payment, you must submit a valid claim form by June 30, 2025. You can submit once the online claim form becomes available or download the PDF claim form and mail it to the settlement administrator.

When is the Designer Brands & DSW payout date?
There is a final approval hearing scheduled for July 31, 2025. Payments will be issued to class members that submitted valid claims approximately 90 days after the court grants the settlement final approval.
Why is there a TCPA class action settlement?
