If you were notified that your personal information was compromised in a data breach involving R&B Corporation of Virginia, you may be eligible to claim up to $2,000 from a class action settlement.

R&B Corporation of Virginia has agreed to pay $1,613,300.45 to settle a class action lawsuit for alleged failure to implement reasonable security measures to protect personal information.

Who can file a claim?

To be part of the settlement, you must have received a notice from R&B indicating that your personal information was compromised in the data breach that occurred in March 2023.

How much can class members get?

Class members can claim up to $2,000 for documented out-of-pocket losses related to the data breach. Alternatively, they can opt for a flat-fee cash payment, which will be determined based on the remaining settlement fund after other expenses are paid.

Reimbursement for Out-of-Pocket Losses

If you incurred documented out-of-pocket losses fairly traceable to the data breach, you may be eligible to receive reimbursement of your losses and expenses up to a total of $2,000 per class member. Eligible losses or expenses include:

  • Long distance telephone charges.
  • Cell phone minutes (if charged by the minute).
  • Internet usage charges (if either charged by the minute or incurred solely as a result of the data breach).
  • Costs of credit reports purchased between March 2, 2023, and the claims deadline.
  • Documented costs paid for credit monitoring services and/or fraud resolution services purchased between March 2, 2023, and the claims deadline.
  • Documented expenses directly associated with dealing with identity theft or identity fraud related to the data breach.
  • Other documented losses incurred by class members that are more likely than not related to the data breach as reasonably determined by the settlement administrator.

Flat-Rate Cash Payment

As an alternative to submitting a claim for out-of-pocket losses, all class members may make a claim to receive a flat-rate cash payment that will be determined based on the money remaining in the settlement fund after the payment of attorneys’ fees and costs, settlement administration costs, class representative service award, and valid claims for out-of-pocket losses. Class members do not need to suffer out-of-pocket losses to be eligible for this payment.

Is proof required to submit a claim?

Yes, proof is required. Claimants must provide documentation supporting their out-of-pocket losses, such as receipts or bank statements. Self-prepared documents alone are insufficient.
