If you received an artificial or prerecorded voice call from Change Healthcare or My Advocate on behalf of Blue Cross Blue Shield of North Carolina, you may be eligible to claim a portion of $1,670,000 from a class action settlement.

Change Healthcare Resources, LLC, has agreed to settle a class action lawsuit for allegedly making such calls without consent, in violation of the Telephone Consumer Protection Act (TCPA).

Who are the class members?

You are a class member if:

  • You received calls from Change Healthcare Resources, LLC, under the brand My Advocate, on behalf of Blue Cross Blue Shield of North Carolina.
  • You were not a member or subscriber of Blue Cross Blue Shield of North Carolina.
  • You opted out of receiving calls from Change Healthcare between January 10, 2019, and July 17, 2024.

How much can class members get?

The settlement fund of $1,670,000 will be distributed to class members on a pro rata basis after deducting Settlement Administration Expenses and a Fee Award.

  • Identifiable Class Members: Automatically receive payment if they do not opt out.
  • Unidentifiable Class Members: Must submit a valid claim to receive payment.

The exact amount each class member will receive depends on the total number of valid claims submitted. For example, if 10,000 valid claims are submitted, each claimant would receive approximately $167 before any deductions for fees and expenses.

If you have not been identified in Defendants’ records or have not received a mailed notice about the Settlement, you may need to file a claim online to receive a payment from the Settlement Fund.
