Cenlar FSB has agreed to pay $714,000 to settle a class action lawsuit for alleged violations of the Telephone Consumer Protection Act (TCPA) and the Rosenthal Fair Debt Collection Practices Act (RFDCPA) in California.
Who are the class members?
The class is divided into two groups:
- TCPA Settlement Class: This includes all individuals in the United States who received an automated call on their mobile phone from Cenlar FSB or its agents, after revoking consent, during the period from December 18, 2016, to December 18, 2021.
- RFDCPA Settlement Sub-Class: This group comprises California residents who requested in writing that Cenlar stop contacting them and subsequently received a letter asking them to sign and return a form or received at least one more call from Cenlar between December 18, 2019, and December 18, 2021.
How much can class members get?
- RFDCPA Settlement Sub-Class: Each member will receive a fixed amount of $100.
- TCPA Settlement Class: The payment is calculated based on the number of calls received. For instance, if the net settlement amount is $496,800 after expenses, and there are 2,251 calls, each call would be worth approximately $218.35. Therefore, a class member who received multiple calls would multiply $218.35 by the number of calls they received to determine their payment.
This tiered approach ensures that compensation is proportional to the impact experienced by each class member.
No action needed to receive compensation
Class members do not need to take any action to receive their settlement payment.
$714,000 Settlement fund
The settlement fund of $714,000 will cover various costs:
- Administrative expenses
- Service award of up to $3,000 for the Class Representative
- Attorneys' fees and costs, up to 30% of the fund
- The remaining balance will be distributed to class members
