Baldor Specialty Foods, Inc. has agreed to pay $550,000 to settle a class action lawsuit for alleged failure to protect the personally identifiable information (PII) of its current and former employees.
Can I Claim an Award?
To be eligible for an award, you must have received a notice from Baldor Specialty Foods, Inc. indicating that your private information was potentially compromised in the data incident. This includes names, addresses, dates of birth, Social Security numbers, and insurance and other benefits information.
Additionally, you must be a current or former employee of Baldor who received the notification about the data breach. If you meet these criteria, you qualify as a Settlement Class Member.
What Awards Can Class Members Claim?
The settlement provides two options for awards:
Option 1: Three years of credit monitoring services, compensation for unreimbursed economic losses up to $10,000, and compensation for lost time up to 6 hours at $25 per hour, totaling up to $150.
Option 2: An estimated $100 cash payment.
The total settlement fund is $550,000. After deducting the costs of notice and settlement administration, court-approved attorneys' fees, costs and expenses, and Class Representative service awards, the net Settlement Fund will be used to pay Settlement Class Members who submit a valid Claim Form.
- Credit Monitoring Services: Includes daily three-bureau credit monitoring, identity restoration services, and $1,000,000 in identity theft insurance.
- Unreimbursed Economic Losses: Out-of-pocket costs related to fraud and identity theft, purchase of identity protection services, credit monitoring services, or ID theft insurance that are fairly traceable to the Data Incident and have not already been reimbursed by a third party. Up to $10,000 with valid documentation.
- Lost Time: Time spent remedying issues related to the Data Incident. Up to 6 hours at $25 per hour, totaling up to $150.
- Cash Payment: An estimated $100, subject to pro rata adjustments based on the number of valid claims filed.
Is Proof Required to Claim the Reward?
Yes, proof is required to claim certain rewards.
- For credit monitoring services, you need to provide your email address.
- For compensation for lost time, you need to attest to the amount of time spent remedying issues related to the Data Incident.

$550,000 Settlement Fund Breakdown
The total settlement amount is $550,000. This amount will be used to cover:

- Court-approved attorneys' fees and litigation expenses
- Class Representative service awards
- Payments to Settlement Class Members who submit valid claims
Class Counsel will request attorneys' fees of $183,333.33, litigation expenses up to $10,000, and $5,000 Service Awards for each of the Class Representatives.
