Air Methods, LLC has agreed to pay $240,000 to settle a class action lawsuit for alleged negligence, negligence per se, breach of implied contract, and unjust enrichment. This lawsuit arose from a security breach where a laptop containing patient information was stolen.
Who can file a claim?
To be eligible for this settlement, you must meet specific criteria:
- You must have received direct notice from Air Methods that your personal information was potentially compromised in the November 2023 security incident.
- You should have received a Unique ID in the Postcard Notice mailed to you.
How much can class members get?
- Documented Out-of-Pocket Losses: You can claim up to $2,500 for unreimbursed costs incurred between November 9, 2023, and December 11, 2024, due to the security incident. These costs may include expenses related to identity theft, fraud, or misuse of personal information.
- Pro Rata Cash Payment: An estimated $75 cash payment is available, subject to adjustment based on the number of valid claims submitted.
- Credit Monitoring: Two years of Identity Defense Total Credit Monitoring services are provided.
The Pro Rata Cash Payment may increase or decrease depending on the total number of claims. For example, if fewer claims are submitted, the payment amount could rise, and if more claims are submitted, it could decrease.
