If Accurate Background conducted a background check on you for employment in California between March 10, 2019, and June 19, 2023, and the report included a criminal conviction, you may be eligible to claim up to $5,000 from a class action settlement.

Accurate Background, LLC has agreed to pay $2,525,000 to settle a class action lawsuit for allegedly misreporting criminal convictions that were older than seven years when measured from the beginning of the parole period.

Who are the class members?

You must meet the following criteria:

  • Accurate Background, LLC performed a background check on you for employment in California.
  • The report contained a criminal conviction.
  • You were discharged from parole within the seven-year period prior to the report date.
  • Your release from incarceration and placement onto parole occurred more than seven years before the report date.

How much can class members get?

Class members could receive up to approximately $5,000.

The exact amount will depend on several factors, including:

  • The number of class members who opt out of the settlement.
  • The court's approval of attorneys' fees and other costs.

The settlement fund will be divided among class members who do not opt out, with each receiving one share of the net settlement fund.

For example, if the net settlement fund is $2,000,000 and there are 400 class members, each would receive $5,000. This calculation is based on dividing the net settlement fund by the number of eligible class members.

Class members do not need to provide documentation to get compensated because the Settlement Administrator already has the necessary information.

Important dates

  • Fairness Hearing: January 10, 2025
  • Deadline to File a Claim: Not applicable since no action is needed.

When is the Accurate Background, LLC payout date?

The court will hold a Fairness Hearing on January 10, 2025, to decide whether to approve the settlement. If approved, payments will be distributed to class members around March 31, 2025.

Why is there a class action settlement?

The lawsuit alleged that Accurate Background, LLC violated California laws by reporting criminal convictions that were older than seven years when measured from the start of parole. Accurate denies these allegations, but both parties agreed to settle to avoid the uncertainties of a trial.
