If you purchased branded Lipitor in West Virginia between March 24, 2010, and November 30, 2011, you may be eligible to claim up to $599 from a class action settlement.

Pfizer and Ranbaxy have agreed to pay $17,000,000 to the state of West Virginia to settle a class action lawsuit for alleged violations of federal antitrust laws. The lawsuit, filed by the WV State Attorney General's office alleged the two companies conspired to delay the introduction of a generic version of Pfizer’s Lipitor that was produced by Ranbaxy.

$3,844,250 of the settlement has been designated for consumers.

Who can file a Lipitor settlement claim?

Eligible class members are as follows:

  • A consumer who purchased, paid, or provided reimbursement for branded Lipitor in West Virginia.
  • The purchase or reimbursement activity must have occurred between March 24, 2010, and November 30, 2011.

How much is the class action payout?

Claimants will receive a pro rata cash payment of up to $599. The payment amount will be determined by the number of claims filed.

How to claim class action rebate

To claim a settlement payment you must submit a claim form. You can file a claim online or print the claim form and mail it to the settlement administrator.

The settlement fund going to the state of West Virginia includes the following:

  • Attorneys' fees: $3,800,000
  • Remaining settlement funds: Municipalities, state agencies, and other costs and expenses
  • Settlement administration: $700,000 paid separately by Pfizer
