If you made or received a call to Viva Aerobus's customer service while in California between August 7, 2022, and November 10, 2023, you may be eligible to claim a monetary award from a class action settlement. Viva Aerobus has agreed to pay $3,950,000 to settle a class action lawsuit for allegedly recording telephone calls without consent.

Who can file a claim?

To be eligible for the settlement, you must meet specific criteria. The settlement class includes individuals who:

  • Resided or were located in California.
  • Made a call to Viva Aerobus's customer service department during the class period from August 7, 2022, to November 10, 2023, that was recorded.
  • Received an outbound call from Viva Aerobus's customer service department during the same period that was recorded.

Viva Aerobus maintains records of the phone numbers involved in these calls. If you received notice of this settlement by mail or email, it indicates that your number might be on the list of qualifying calls. If you did not receive such notice but believe you qualify, you can contact the Claims Administrator to verify your eligibility.

How much can class members get?

The settlement fund is $3,950,000, with an estimated $2,433,334 available for distribution after fees and costs. The per-call value is approximately $21.45, but due to expected claim rates, members might receive around $100 per call. The actual amount depends on the number of claims submitted and the number of calls per claimant.

  • Single Call Claim: Approximately $100
  • Multiple Calls: Multiply the number of calls by $100 for an estimate.
