USAA $3.25M Data Breach Class Action Settlement

If you are an individual in the United States whose personal information was accessed, stolen, or compromised due to unauthorized access to USAA's insurance quotation platform, you may be eligible to claim a portion of a class action settlement.

United Services Automobile Association (USAA) has agreed to pay $3,250,000 to settle a class action lawsuit for alleged negligence in protecting personal information caused by a data security incident, violations of the Driver’s Privacy Protection Act, and other related claims.

Who is eligible to receive a USAA data breach payment?

Eligibility requirements:

• Customers and prospective customers whose data was accessed through USAA's insurance quotation platform in the May 6, 2021 data incident
• Those who received notification from USAA regarding the data breach
• United States residents only

How much is the USAA data breach settlement payout?

Class members that submit a payment election or are otherwise located by the settlement administrator will receive a pro rata cash payment.

How to claim a USAA payment

A claim form is not required. However, it is recommended that class members submit a Payment Election Form with updated address information and payment type selection.

The Payment Election Form can be submitted online or there is a PDF election form that can be downloaded and mailed to the settlement administrator. The deadline to submit the Payment Election Form is April 7, 2025.

$3.25 Million settlement fund

The settlement fund of $3,250,000 will cover various costs and payments to class members:

• Payments to class members
• Settlement administration costs
• Attorneys' fees of up to $1,083,333 plus expenses
• Service award to class representative of up to $10,000

When is the USAA data breach settlement payment date?

The final hearing scheduled for May 21, 2025. Once the court grants the settlement final approval, payments will be issued to class members that submitted a Payment Election Form or were otherwise located by the administrator.

Why was there a class action settlement?

The lawsuit was filed against USAA for allegedly failing to implement reasonable data security measures, resulting in unauthorized access to personal customer and prospective customer information.

The settlement was reached to avoid prolonged litigation and a possible trial. USAA has not admitted any wrongdoing.
