If you were insured under a Georgia auto policy issued by Travelers Property and Casualty Insurance Company and submitted a claim for a total loss between January 1, 2020, and April 1, 2022, you may be eligible to claim compensation from a class action settlement.
Travelers has agreed to settle a class action lawsuit for allegedly underpaying title ad valorem tax (TAVT) on total loss vehicle claims.
Who are the class members?
- You were insured under a Georgia automobile policy issued by Travelers.
- You submitted a claim that was paid as a total loss by Travelers between January 1, 2020, and April 1, 2022.
- You did not receive a full 6.6% payment of the vehicle's total loss value for TAVT.
If you meet all these conditions, you are likely a class member.
How much can class members get?
Class members who submit a valid and timely claim will receive a settlement check. The amount is calculated as 75% of the difference between 6.6% of the vehicle's total loss value and the amount previously paid by Travelers for TAVT.
Payment methods
Class members will receive their settlement payments via check.
Important dates
- Fairness Hearing: July 10, 2024
- Deadline to File a Claim: August 26, 2024
When is the Broadbent v. Travelers payout date?
The awards will be paid after the court grants final approval of the settlement, and any appeals are resolved.
Why is there a class action settlement?
The lawsuit alleged that Travelers failed to pay the full TAVT on total loss vehicle claims. The settlement was reached to avoid further litigation costs and risks.
What happens next?
The court held a final fairness hearing on July 10, 2024, to decide whether to approve the settlement. If approved, payments will be distributed to eligible class members who submitted valid claims.
