If you were employed as a non-exempt employee by J.T. Thorpe & Son, Inc. and/or Kevin Howard at the Shell Cracker Plant in Monaca, Pennsylvania, during any workweek between February 24, 2020, and July 3, 2022, you may qualify to submit a claim for compensation from a class action settlement.

J.T. Thorpe & Son, Inc. and Kevin Howard have agreed to pay $550,000 to settle a class action lawsuit alleging violations of the Pennsylvania Minimum Wage Act (PMWA). The lawsuit claims that the defendants failed to pay proper overtime wages for pre-shift and post-shift work activities.

Who is eligible to receive a settlement payment?

Class members meet the following criteria:

  • You were employed as a non-exempt employee by J.T. Thorpe & Son, Inc. and/or Kevin Howard at the Shell Cracker Plant in Monaca, Pennsylvania.
  • Your employment consisted of at least one workweek between February 24, 2020, and July 3, 2022.

How much is the class action payout?

If approved, the net settlement fund available for distribution to class members who submit a valid claim is $307,604.60.

  • Individual payments will be calculated based on the total number of hours worked at the Shell Cracker Plant during the class period.
  • For every 40 hours worked, approved claimants will receive approximately $21.20.
  • Settlement payments will be treated as wages with applicable taxes and withholdings deducted, and W-2 received from the IRS.

How to claim an overtime class action settlement payment

To receive a payout, you must complete and submit the claim form that was mailed to you with the settlement notice. This is the only way to receive a payment.

The completed claim form must be mailed to the settlement administrator and postmarked no later than June 9, 2025.

When is the J.T. Thorpe & Son, Inc. class action settlement payout date?
