Southern Regional Jail $4 Million Class Action Settlement

If you were an inmate at the Southern Regional Jail for more than two days since September 22, 2020, you may be eligible to claim between $150 and $500 from a class action settlement.

West Virginia has agreed to pay $4,000,000 to settle a class action lawsuit for alleged inhumane conditions and improper treatment at the Southern Regional Jail. The lawsuit will continue against the medical providers to the jail, Primecare and Wexford.

Who are the class members?

To be part of this settlement, you must have been one of the 7,850 current and former inmates at the Southern Regional Jail for more than two days anytime between September 22, 2020, and July 19, 2024.

How much can class members get?

Class members can expect to receive payments ranging from $150 to $500. The exact amount will depend on the total number of claims filed and the length of time each claimant was incarcerated. The settlement fund of $4,000,000 will be distributed among eligible claimants.

• Inmates incarcerated for longer periods: May receive closer to the higher end of the range.
• Inmates with shorter incarceration periods: May receive amounts closer to the lower end of the range.

If the number of claims exceeds the available funds, the settlement amounts may be prorated. For example, if the total number of claims results in a payout exceeding $4,000,000, each claimant's award will be reduced proportionally.
