
If you received two or more telemarketing calls from Momentum Solar or on its behalf within a 365-day period between March 5, 2015, and January 2, 2025, you may be eligible submit a claim for a class action settlement.
Pro Custom Solar LLC, operating as Momentum Solar, has agreed to pay between $20 million and $30 million to settle two class action lawsuits alleging violations of the Telephone Consumer Protection Act (TCPA) and related state telemarketing laws. The lawsuits claim that Momentum Solar made unsolicited telemarketing calls regarding solar services or products without recipients' consent.
Who is eligible for a TCPA settlement payment?
You are a class member if:
- You reside in the United States and received two or more telemarketing calls from Momentum Solar or its agents. .
- The calls occurred within any 365-day period between March 5, 2015, and January 2, 2025.
- You are not currently, nor have you ever been, a customer of Momentum Solar.
How much is the class action payout?
Pro Rata Cash Payment: Approved claimants will receive a cash payment per call, for up to 50 qualifying calls. Payment amount will be determined by the number of claims filed and available settlement funds.
How to claim a TCPA payment
To receive a class action rebate, class members must file a claim online or print and mail a completed PDF claim form.
Claims must be submitted online or postmarked by July 31, 2025.

Settlement fund of up to $30 Million
The exact amount Momentum Solar will pay into the settlement fund depends on the timing and conditions, which are outlined in the settlement agreement.
The settlement fund, ranging from $20 million to $30 million, will include:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to 1/3 of the total settlement fund, ranging from about $6.67 million to $10 million
- Attorneys' expenses: To be submitted to the court for approval at a later date
- Service awards to class representatives: $7,500 for Thomas Niemczyk, and $5,000 each for Rick Hill and Barry Wolford
- Payments to approved claimants: Remaining settlement funds after deductions
