South Florida Behavioral Health Network Incorporated, known as Thriving Mind, has agreed to pay $900,000 to settle a class action lawsuit related to allegations of a data breach incident.
The lawsuit claims that between August 1 and August 3, 2023, unauthorized individuals accessed sensitive personal information, including names, addresses, Social Security numbers, birth dates, health insurance details, and medical information belonging to current and former patients.
Who is eligible for a data breach payout?
You reside in the United States and received notification sent to former and current patients of Thriving Mind stating your private information may have been compromised in August 2023.
How much will the class action payment be?
Class members can claim one or more of the following:
- Cash Payment A - Documented Losses: Class members can claim up to $5,000 in documented monetary losses traceable to the data breach. Losses may include credit monitoring expenses, out-of-pocket expenses, and unreimbursed charges due to fraud.
- Cash Payment B - Flat Cash: Class members that do not submit a Documented Losses claim can submit for a pro rata cash payment, estimated to be $100.
- Credit Monitoring Service: All class members can also submit for one year of credit monitoring from three major credit bureaus, which has a value of approximately $90.
How to claim a data breach settlement payout
To receive your class action rebate, you must submit a claim by the deadline of July 14, 2025. Class members can file a claim online or print and download the PDF claim form to mail to the settlement administrator.
