If you visited certain fertility clinic websites between January 1, 2020, and April 4, 2025, you may be eligible to claim a cash payment from a class action settlement.
San Diego Fertility Center Medical Group, Inc. and Ivy Fertility Services, LLC have agreed to pay $850,000 to settle a class action lawsuit for alleged privacy violations. The lawsuit claimed that these companies improperly shared personally identifiable device information of website users, in violation of their privacy policies and applicable law.

How much is the class action rebate?
Pro Rata Cash Payment: Each approved claimant will receive a cash payment. Payment amount will be determined by the number of claims filed.
How to claim a settlement payout
To claim a settlement payment, class members must submit a claim form by the June 24, 2025 deadline. You can do this online or by mail:

- To submit a claim by mail, download and print the PDF claim form to mail it to the settlement administrator.

$850,000 class action settlement fund breakdown
The settlement fund of $850,000 will include the following payments:
- Settlement administration costs: To be determined
- Attorneys' fees: Not to exceed $283,333.33
- Attorneys' expenses: To be presented to the court at a later date
- Service awards to the class representative: $2,500
- Payments to approved claimants: The remainder of the settlement fund after deductions

When is the fertility website privacy settlement payout date?
Payments to class members with valid claims will be made approximately 60 days after the court grants final approval of the settlement. The final fairness hearing is currently scheduled for July 18, 2025.
Why was there a class action settlement?
This class action lawsuit was filed because plaintiffs alleged that San Diego Fertility Center Medical Group, Inc. and Ivy Fertility Services, LLC shared personally identifiable device information of website users, violating their privacy policies and the law. The defendants deny all allegations of wrongdoing and maintain that they did not share any patient records or personal medical information.
All parties involved agreed to settle to avoid the costs further litigation and a trial.
