If you received prerecorded or artificial voice calls on your cell phone from United HealthCare Services, Inc. regarding the Optum® HouseCalls program, and you were neither a UnitedHealthcare member nor authorized to represent one, you may be eligible to claim between $50 and $125 from a class action settlement.

United HealthCare Services, Inc. has agreed to pay $3.495 million to settle a class action lawsuit alleging violations of the Telephone Consumer Protection Act (TCPA). The lawsuit, titled _Johnson v. United HealthCare Services, Inc._, claims that United HealthCare placed prerecorded or artificial voice calls regarding Optum® HouseCalls to cellular phones without obtaining prior express consent from recipients.

Who is eligible for a United HealthCare TCPA settlement payment?

Class member eligibility requirements :

  • Received at least one prerecorded or artificial voice call to your cellular phone from United HealthCare regarding the Optum® HouseCalls program related to a UnitedHealthcare plan
  • Were not a UnitedHealthcare member or plan holder, or authorized to represent one at the time of the call
  • The call occurred between October 12, 2019, and February 10, 2025

How much are the payouts?

Class members who submit a valid claim form can expect to receive between $50 and $125. The exact amount each claimant receives depends on the total number of valid claims submitted.

The settlement fund of $3,495,000 will first cover settlement administration costs, attorneys' fees, and litigation expenses. After these deductions, the remaining amount will be equally divided among all approved claimants.

In a hypothetical example, if there is a net settlement fund of approximately $1,974,000 and if there are 20,000 valid claims are submitted, each claimant would receive approximately $98.70 ($1,974,000 ÷ 20,000 = $98.70).

How to claim a United HealthCare TCPA settlement payout

To receive compensation, you must submit a valid claim form by April 25, 2025. You can file a claim online or download, complete, and mail the PDF claim form to the settlement administrator.

Ensure your claim is postmarked or submitted online no later than April 25, 2025. The settlement administrator says late claims will not be accepted.

  3. Sign and date the claim form.
  4. If mailing, send the completed form to the Settlement Administrator's address provided above.
  5. Double-check to ensure your claim is submitted online or postmarked by April 25, 2025.

Payout options

Payments will be issued via mailed check to the address provided on your claim form. No other payment options are available.

$3.495 Million settlement fund

The settlement fund of $3,495,000 will cover various costs associated with the settlement, including:

  • Settlement administration costs: Up to $306,000
  • Attorneys' fees: Up to one-third of the settlement fund ($1,165,000)
  • Attorneys' litigation expenses: Up to $50,000
  • Payments to class members: Remaining balance after deductions

The named plaintiff, Elaine Johnson, negotiated a separate settlement with United HealthCare Services, Inc. for claims unrelated to this class action. Her separate settlement does not affect the amount available to class members.

When is the Johnson v. United HealthCare Services payout date?

The court will hold a Final Fairness Hearing on July 10, 2025. If approved and there are no appeals, payments will be mailed no later than 30 days afterwards. If there are appeals, payments may be delayed until they are all resolved.
