Orrick, Herrington & Sutcliffe LLP has agreed to pay $8,000,000 to settle a class action lawsuit for alleged mishandling of personal data leading to a data breach.
Who Can Submit a Claim?
To be eligible for the settlement, you must be a resident of the United States who received a notice from Orrick, Herrington & Sutcliffe LLP about the data breach.
These notices were sent from around March 2023 to December 2023. If you received such a notice, you are considered a Settlement Class Member and may be eligible for benefits under the settlement.
How Much Can Class Members Claim?
The settlement provides several types of compensation for class members:
- Compensation for Lost Time: If you spent time addressing issues related to the data breach, you can claim reimbursement for up to 5 hours at a rate of $25.00 per hour.
- Credit Monitoring: You can claim three years of three-bureau credit monitoring services, including $1 million in identity theft insurance.
- Compensation for Out-of-Pocket Expenses: If you incurred actual, unreimbursed expenses as a result of the data breach, you can claim up to $2,500.00. Examples include costs spent addressing identity theft or fraud, purchasing credit monitoring, placing security freezes on credit reports, or other documented losses.
- Compensation for Documented Extraordinary Loss: If you experienced out-of-pocket losses for actual identity theft or fraud, you can claim up to $7,500.00.
- CCPA Payment: California residents can claim a payment of $150.00 in recognition of their claims under the California Consumer Privacy Act.
- Alternative Cash Payment: In lieu of submitting a claim for lost time, out-of-pocket expenses, or extraordinary loss, you may claim a $75.00 Alternative Cash Payment.
If the total amount of approved claims exceeds the settlement amount, the claims will be subject to a pro rata reduction.
Is Proof Required to Submit a Claim?
Yes, claimants need to provide proof to claim certain awards:
- For lost time, claimants must represent that the time spent was incurred as a result of the data breach.
- For out-of-pocket expenses and extraordinary losses, claimants must submit documentation such as credit card statements, bank statements, invoices, telephone records, and receipts.
- For the CCPA payment, claimants must be California residents during the specified period.

How are Claims Paid?
