Who is eligible for a settlement payout?
You qualify to submit a claim if you:
- Purchased Saks Fifth Avenue-branded products at a Saks OFF 5TH store in California or online at www.saksoff5th.com with a bill to or ship to address in California
- Purchase dates are between January 1, 2011 to November 1, 2024
- Made purchases at a discount from the advertised "Market Price in-store or online
- Did not receive a refund or credit for their purchases between January 1, 2011, and November 1, 2024
There are two tiers of class members:
- Tier 1 Authorized Claimant: Class members that received a direct notice of the settlement do not need to submit a claim form
- Tier 2 Authorized Claimant: Class members that did not receive notice, but made one or more qualifying purchases during the class period must submit a claim form
How much will my Saks OFF 5TH settlement payment be?
Approved claimants will receive a merchandise certificate valued at up to $20. The certificates are reusable, stackable with other promotions, but cannot be combined with another certificate from this settlement. These merchandise certificates are not redeemable for cash and cannot be used to purchase gift cards or services.
- Tier 1 Authorized Claimant (no claim form required): One Saks OFF 5TH merchandise certificate for $20 toward future purchases
- Tier 2 Authorized Claimant: One Saks OFF 5TH merchandise certificate for up to $20. If the claimed value of the Tier 2 merchandise certificates exceeds $1,500,000, the value of each Tier 2 individual certificate will be reduced pro rata
Is proof required to submit a claim and receive a certificate?
- Tier 2 Authorized Claimants must provide proof of qualifying purchases during the class period
- Receipt showing the date and total amount of purchase
- Credit card or bank statement showing date and total amount of purchase
How to claim a Saks OFF 5TH deceptive pricing settlement payout
- Tier 1 Authorized Claimants do not need to submit a claim form, and will automatically receive a merchandise certificate
- Tier 2 Authorized Claimants must submit a claim form along with proof of purchase. You can file a claim online or download and print the PDF claim form to mail to the settlement administrator.
