Who is eligible for a settlement payment?
The settlement class includes all individuals residing in the United States whose private information was accessed during the data incident. This includes those who received a Notice Letter notifying them of the compromise.
- Current and former NOW employees and their dependents residing in the United States whose personal and health information was compromised in the 2023 breach.
- Individuals that received a data breach notice from NOW Health Group, Inc.
How much is the data breach payout?
Class members can claim one or more of the following benefits:
- Credit Monitoring and Insurance Services: Two years of one-bureau credit monitoring and fraud protection, including $1 million insurance coverage.
- Lost Time Reimbursement: Up to four hours at $25 per hour for time spent dealing with the data breach, capped at $100.
- Ordinary Unreimbursed Losses: Up to $650 for documented out-of-pocket expenses such as bank fees, postage, fees for credit monitoring services.
- Extraordinary Unreimbursed Losses: Up to $5,500 for documented financial losses resulting from identity theft or fraud caused by the data incident.
How to claim a class action settlement payment
To claim a payout class members must submit a claim form. The claim deadline is June 4, 2025. The easiest way is to file a claim online. Class members can also download and print the PDF claim form to mail to the settlement administrator.

- Unique ID and PIN from notice required to submit online.
- Ordinary Unreimbursed Losses: Third-party documentation required such as bank statements and receipts or invoices for other services paid for when dealing with the cybersecurity incident.
- Extraordinary Unreimbursed Losses: Third-party documentation required such as police reports, bank or credit card letters confirming unreimbursed fraudulent charges, and any other invoices and proof of monetary losses traceable to the breach.

Data breach settlement funds
The settlement funds include:
