- You must have worked for New Hope Harvesting, LLC during the PAGA Period to be eligible for civil penalties.
What Awards Can Class Members Claim?
The awards available to class members are divided into Class Payments and Civil Penalties Payments. The exact amount you can claim depends on the number of workweeks you worked during the Class Period and the PAGA Period.
- Class Payments: calculated by dividing the Net Settlement Amount by the total number of workweeks worked by all Participating Class Members, and then multiplying the result by the number of workweeks you worked within the Class Period.
- Civil Penalties Payments: calculated by dividing $3,750.00 by the total number of PAGA Pay Periods worked by all Aggrieved Employees, and then multiplying the result by the number of PAGA Period Pay Periods you worked within the PAGA Period.
For example, if the Net Settlement Amount is $500,000 and the total number of workweeks worked by all Participating Class Members is 10,000, then the payment per workweek would be $50. If you worked 100 workweeks during the Class Period, your Class Payment would be $5,000.
Similarly, if the total number of PAGA Pay Periods worked by all Aggrieved Employees is 1,000, then the payment per PAGA Pay Period would be $3.75. If you worked 50 PAGA Pay Periods, your Civil Penalties Payment would be $187.50.
