If you are an individual residing in the United States who received a notification letter from MarineMax, Inc. or Newcoast regarding a data incident that occurred around March 2024, you may qualify to submit a claim for a cash payment of up to $5,000 from a class action settlement.

MarineMax, Inc. has agreed to a settlement amount of $1,018,825.50 to resolve a class action lawsuit arising from allegations related to unauthorized access to its data environment. The 2024 data breach potentially exposed the personal information of approximately 123,494 individuals.

Who is eligible for a data breach payout?

  • Individuals in the United States whose personal information (PII) was compromised as a result of the MarineMax data breach reported in July 2024.
  • You received a notification from MarineMax, Inc. or Newcoast informing you that your personal data was potentially breached during the 2024 data incident

How much will the class action settlement payment be?

Class members can claim any or all of the following:

  • Actual Identity Theft Losses: Reimbursement of up to $5,000 for documented identity theft losses that can be reasonably traced to the Data Incident. Examples include fraudulent charges, unauthorized accounts opened in your name, or other identity theft-related financial losses.
  • Out-of-Pocket Expenses: You may claim up to $2,000 for documented expenses directly related to the Data Incident. Eligible expenses include professional fees paid, freezing/unfreezing credit costs, and credit monitoring services purchased after you were notified
  • Credit Monitoring Services:
    • If you did not previously accept the MarineMax offer of two years of credit monitoring, you can sign up for three years of one-bureau credit monitoring.
    • If you previously signed up for the two-year credit monitoring offer, you can receive an additional 12 months of one-bureau credit monitoring.
  • Cash Payment: Pro rata cash payment from remaining settlement funds after claims and expenses are paid, capped at $500.

How to claim a data breach class action rebate

To receive a settlement payout, class members must submit a claim form. You can file a claim online or print the PDF claim form to print and mail to the settlement administrator.

Completed claim forms must be submitted online or postmarked no later than June 13, 2025 deadline.

Is proof required to submit a data breach claim?

Yes., supporting documentation is required for certain claims.

  • Unique ID from notice required to submit a claim.
  • Actual Identity Theft Losses claims: Debt collection letters, proof of unauthorized accounts or tax returns filed in your name, police report, bank and credit card statements with letter confirming fraudulent charges that were unreimbursed.
  • Out-of-Pocket Expenses claims: Copy of professional services invoice, proof of credit monitoring services payment and other associated fees.

$1.02 Million class action settlement fund

The settlement fund of $1,018,825.50 will include:

  • Settlement administration costs: No more than $150,000
  • Attorneys' fees: Up to $339,268.90
  • Attorneys' expenses: Up to $10,000
  • Credit monitoring costs: Determined by number of valid claims filed
  • Payments to approved claimants: Remaining settlement fund balance

When is the MarineMax data breach settlement payment date?

The court will hold a final approval hearing on June 17, 2025. Payments to class members with approved claims will be issued after the judge grants final approval and any appeals are resolved.
