If youR personal information was potentially compromised in the data breach experienced by Great Valley Cardiology (GVC) between February 2 and April 3, 2023, you may be eligible to claim up to $5,000 from a class action settlement.

Commonwealth Health Physician Network, doing business as Great Valley Cardiology, and Scranton Cardiovascular Physician Services, LLC, have agreed to pay $2,000,000 to settle a class action lawsuit for alleged mishandling of personal information during a cybersecurity incident.

Who can submit a claim?

The settlement class includes all individuals whose personal information was potentially compromised in the data breach and who were sent the Notice of Data Privacy Incident on or around June 2023. If you received this notice, you are likely eligible to submit a claim.

To be a part of the settlement class, you must meet the following criteria:

  • You are an individual residing in the United States.
  • Your personal information was compromised in the data breach experienced by GVC between February 2 and April 3, 2023.
  • You received the Notice of Data Privacy Incident on or around June 2023.

How much can class members get?

Class members can claim various awards depending on their circumstances.

The settlement provides for:

  • Documented Loss Payments: Up to $5,000 per claimant for actual, documented, and unreimbursed monetary losses arising from identity theft, fraud, or similar misuse. This includes reimbursement for time spent remedying issues related to the data breach at $25 per hour for up to six hours (totaling $150).
  • Cash Fund Payment: A pro rata share of the settlement fund if you do not claim documented losses.
  • Credit Monitoring and Insurance Services (CMIS): Two years of credit monitoring and identity theft protection services with $1 million in insurance.

For example, if a class member claims documented losses totaling $2,000 and also spent six hours remedying issues related to the data breach, they could claim a total of $2,150 ($2,000 for documented losses plus $150 for time spent).

Is proof required to submit a claim?

Yes, proof is required to claim an award. Claimants must provide documentation to support their claims for documented losses. However, no documentation is needed for lost-time claims, but claimants must attest that the time claimed was actually spent as a result of the data breach.

  • Documented Loss Payments: Requires supporting documentation demonstrating actual, unreimbursed monetary loss.
  • Cash Fund Payment: No documentation required, but claimants must attest to their eligibility.
