If you purchased Gerber Good Start Gentle infant formula in Florida or New York between October 10, 2011 and April 23, 2016, you may qualify to claim between $3 and $80 from a class action settlement.
Gerber Products Co has agreed to pay to settle a class action lawsuit for alleged false advertising statements claiming Good Start Gentle infant formula products could reduce the risk of allergies. Gerber denies it made any misleading statements.
Who is eligible for a Gerber formula payment?
Class members include the following consumers:
- You purchased Gerber Good Start Gentle infant formula in the states of Florida or New York.
- The formula purchases were made during the time period of October 10, 2011 to April 23, 2016.
- One claim per household.
Who is excluded from the settlement?
- Purchases made for resale
- Formula received by a person via the governmental WIC program
How much is the class action settlement payout?
- Florida Class Member Base Payment: $3 per unit for up to 5 units for a total of $15.00 with no proof of purchase.
- Claim requires proof of Florida residency, along with birthdate, current age of infant for whom GSG was purchased for, and infant's relationship to claimant.
- New York Class Member Base Payment: $4 per unit for up to 5 units for a total of $20.00 with no proof of purchase.
- Claim requires proof of New York residency, along with birthdate, current age of infant for whom GSG was purchased for, and infant's relationship to claimant.
- Enhanced Proof of Purchase Payment: In addition to a Base Payment, class members may also provide proof of purchase and claim up to a maximum of 20 units.
- A total of $60 for Florida purchases.
- A total of $80 for New York purchases.
How to claim a Gerber settlement payment
To claim a formula payout, class members must submit a claim form when it becomes available. You will be able to file a claim online or download the PDF claim form and mail it to the settlement administrator.

Required proof
Yes, claimants need to provide proof of purchase, such as a receipt or bank statement, to claim an award.
- All claims: Florida or New York proof of residency must be provided
- Copy of driver's license or state issued ID
- Copy of residential lease or mortgage
- Utility bill, payment card statement, or paystub showing address
- Extended Proof of Purchase Payment claims: Proof of purchase of the Geber formula in Florida or New York during the class period
- Receipts, invoices, payment-card records showing date of purchase, specific product and number of units purchased, and purchase amount
Payout options
Payment selections will be made available with claim form.
Settlement fund
The settlement fund will cover all eligible claims, attorneys' fees, and administration costs.
- Settlement administration costs: Up to $750,000
- Attorneys' fees and expenses: Up to $11,250,000
- Service awards to the two class representatives: Up to $10,000 each
- Payments to approved claimants: Determined by number of claims filed

When is the Gerber formula settlement payout date?
A final approval hearing date will be scheduled by the court. Payments are estimated to be issued to approved claimants 90 days after the settlement is granted final approval.
Why was there a class action settlement?
The lawsuit alleged that Gerber engaged in false advertising by marketing Good Start Gentle infant formula as a product that could reduce the risk of allergies, leading consumers to make purchases based on misleading information. The settlement was reached to avoid the costs of further litigation.
